1. Acceptance of Terms

By accessing or using wuvist.com (the "Platform"), operated by Aspire Business Consulting SRL, CUI/CIF: 17835618, J40/13456/2005, registered in Romania, EU, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the Platform.

These terms apply to all visitors, registered users, content creators, and any other person who accesses or uses the Platform.

2. User Accounts

To access certain features, you must create an account using our authentication provider (Clerk). You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms or remain inactive for an extended period.

3. Booking and Payments

Wuvist facilitates hotel and accommodation bookings through third-party suppliers. When you make a booking:

• Prices are displayed in the currency indicated and include applicable taxes unless otherwise stated
• All payments are processed securely through Stripe, our PCI-compliant payment processor
• A booking is confirmed only after successful payment and receipt of a confirmation email
• We act as an intermediary between you and the accommodation provider; the contractual relationship for the stay is between you and the provider
• Room availability and pricing are subject to real-time changes until a booking is confirmed

By completing a booking, you confirm that you are at least 18 years of age and that the payment method used belongs to you or that you are authorized to use it.

4. Cancellation and Refunds

Cancellation policies vary by accommodation provider and are displayed during the booking process. Please review the specific cancellation terms before confirming your booking.

• Free cancellation bookings may be cancelled at no charge before the specified deadline
• Non-refundable bookings cannot be cancelled or modified after confirmation
• Refunds, where applicable, will be processed to the original payment method within 5-10 business days
• Wuvist is not responsible for cancellations or changes made by the accommodation provider

5. Creator Program

Wuvist offers a Creator Program that allows eligible users to earn commissions by promoting accommodations. By participating:

• Commission rates range from 25% to 45% of platform revenue, based on creator tier
• Referrals are tracked via unique creator links with a 90-day cookie attribution window
• Commissions are earned only on completed, non-refunded bookings
• Payouts are processed monthly for earnings exceeding the minimum threshold

Content Rules

Creators must comply with the following when promoting wuvist:

• All promotional content must be clearly disclosed as containing affiliate links, in compliance with applicable advertising regulations
• Content must be honest and not misleading regarding accommodations, prices, or availability
• Creators must not use spam, misleading advertising, or any deceptive practices
• Wuvist reserves the right to terminate a creator's participation and withhold unpaid commissions for violations

6. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, icons, images, software, and the wuvist brand identity, is the property of Aspire Business Consulting SRL or its licensors and is protected by international copyright and trademark laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any Platform content without our prior written consent. Hotel images and descriptions are provided by our accommodation partners and remain their property.

7. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the Platform or its systems
• Interfere with or disrupt the integrity or performance of the Platform
• Scrape, crawl, or use automated means to access the Platform without our permission
• Submit false or misleading information, including fraudulent bookings
• Harass, threaten, or impersonate other users

8. Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the maximum extent permitted by law:

• Aspire Business Consulting SRL shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
• We do not guarantee the accuracy, completeness, or reliability of accommodation listings, prices, or availability
• We are not responsible for the quality, safety, or legality of accommodations booked through the Platform
• Our total liability for any claim arising from use of the Platform shall not exceed the amount paid by you for the specific booking in question

9. Privacy and GDPR

We are committed to protecting your personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable Romanian data protection laws. Our collection, use, and processing of personal data is described in detail in our Privacy Policy.

By using the Platform, you acknowledge that you have read and understood our Privacy Policy and consent to the processing of your personal data as described therein.

10. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Your continued use of the Platform after any changes constitutes your acceptance of the new terms. We will notify registered users of material changes via email.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Romania and applicable European Union regulations. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the competent courts in Romania.

For EU consumers: nothing in these terms affects your statutory rights under applicable consumer protection legislation. You may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
